External Review of Trinity Metals Land Acquisition Processes and Procedures

SCOPE OF WORKS

  1. Preamble

Trinity Metals Limited (the Company) is a privately owned company engaged in the mining and exploration of tin, tungsten, tantalum and lithium in Rwanda. The Company is currently developing and operating three mining complexes in Rwanda near the city of Kigali: Rutongo Mine (tin); Trinity Nyakabingo Mine (tungsten); and Trinity Musha Mine (tin and tantalum, with lithium exploration).

The company has been expanding its operations progressively over the past 2,5 years since Trinity Metals was formed. In some cases, the expansion of operations requires the acquisition of nearby land, used either for subsistence agricultural and/or for residential purposes. The Company has in place a Land Clearance Procedure which is aligned with Rwandan legislation related to expropriation of land for purposes in the national interest.

Trinity Metals is currently seeking international investment to fund the expansion, modernisation and mechanisation of the existing operations. In support of this, the Company is in the process of updating the mines’ Environmental and Social Impact Assessments (ESIAs) and Management Plans (ESMPs). These assessments and plans are fully aligned to international funder standards for environmental management, specifically, the IFC Performance Standards.

Furthermore, Trinity Metals is in the process of implementing an ISO14001/45001-aligned integrated SHEC management system. Part of this exercise is reviewing and improving the current procedures to align – where practicable – with good international industry practices (GIIP), in particular the IFC Performance Standards (PS) on Environmental and Social Sustainability.

Trinity Metals requires a suitably qualified and experienced professional consultancy to conduct an independent assessment of the historic land acquisition exercises, review formal land acquisition procedures, and develop an approach and roadmap to ensure a holistic approach to future land access for the life of mines, consistent with international standards and best practice, specifically IFC PS5.

Details of the Scope of Work are provided below:

Phase 2: Land Access Roadmap

  • Develop an Approach and Roadmap for future land access consistent with international standards and best practice, specifically IFC PS5 – Land Acquisition and Involuntary Resettlement. Roadmap to include:
  • Corrective actions design and implementation in respect of identified historic land access issues and risks.
  • Alignment of land access and resettlement planning, and wider social plans, with life-of-mine plans.
  • Grievance mechanism development and management.
  • Comprehensive land access management, including assessment, planning and implementation, consisting of, but not limited to: preliminary analysis and costing of land access (desktop); stakeholder engagement planning and implementation; baseline survey planning implementation and analysis; community and household level negotiations and agreement making; household sign-off and moves; livelihood restoration planning and implementation; and monitoring and evaluation
  • Land Management Framework and a Resettlement Acton Plan which can act as both guidance and templates for future land access needs.
  • Ongoing assistance to include provision of guidance, tools and templates to the client team, developed to be practical and tailored to the local context.

  • Overall, the work should be completed within 10 months of appointment.
  1. Qualifications and Experience

Only qualified and experienced firms specialising in managing land access and resettlement to relevant international standards and best practice need apply. Applicants must have experience with implementing land access projects on the ground in Rwanda and internationally, in accordance with national laws and in alignment with the IFC PS5 on land acquisition and involuntary resettlement. Individuals proposed for the project team must be suitably qualified and experience in land access, resettlement and livelihood restoration.
